Terms of service

These are the basic terms under which we work together. We've kept them short and plain. The full engagement (scope, deliverables, dates, price) goes in a written statement of work signed by both sides before any work starts.

What we do

aërgap deploys, configures and runs open-source business software (such as Zammad, Odoo Community, Kimai and Docusaurus) and our own products (such as Classverse) on infrastructure that you own. We also offer consulting by the hour after launch.

How we charge

• One-time setup fee per deployment, agreed in writing before work begins.
• Consulting billed at $50 per hour, in 15-minute increments, after launch.
• Managed care (optional, monthly) for ongoing monitoring, patching and small changes.
• Hosting is paid by you to your own cloud provider. We never resell hosting.

Prices on the website are starting points. Exact pricing for your project is confirmed in writing before we start.

What you own

You own:

• Your data, in its entirety, at all times.
• Any custom modules, configuration or code we write for you, delivered to a Git repository you control.
• Your infrastructure (cloud account, on-prem servers, domain names).

If you ever stop working with us, the software keeps running. You can hire any qualified engineer to take it from there.

Open-source licenses

The open-source tools we install carry their own licenses (such as AGPLv3 for Zammad, LGPLv3 for Odoo Community). We are not the authors of those tools and we are not affiliated with the companies behind them. Their licenses continue to govern your use of them.

Refunds

Pre-paid consulting hours that have not yet been used are refundable on request. Setup fees become non-refundable once we have started discovery work, which is the point at which we are turning down other projects to take yours. We will always tell you in writing when this point is reached.

What we don't promise

Software has bugs. Networks go down. Third-party services change. We will work hard, document everything, and respond quickly when something goes wrong, but we cannot guarantee uninterrupted service. Specific service-level commitments, if any, are written into your statement of work.

Liability

To the extent permitted by applicable law, our total liability to you under any engagement is capped at the fees you have actually paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses (lost revenue, lost data unrelated to our work, etc.).

Confidentiality

We treat anything you share with us during scoping or delivery as confidential and won't share it with third parties without your written permission. A separate NDA is available on request.

Changes to these terms

If we change anything material, we'll update the date at the top of this page. Live engagements continue under the terms in force when they were signed.
